Penal Code 1000

In the state of California, when a person is charged with a drug crime, the court may rule that the person is eligible for Penal Code 1000 after examining the person’s prior criminal history and personal background.  If the person has no prior drug crime offenses on his/her criminal record, or if the person is being charged with a drug or alcohol related crime for the first time, the court may rule that the person undergo treatment and/or rehabilitation instead of spending time in jail or prison.

If a person has been charged with a drug or alcohol related criminal offense in Orange County, pc1000 can help him/her avoid jail time or imprisonment.  In California, it is believed that a person will get more value from treatment programs than incarceration.  It is also believed that after thorough rehabilitation, a person will be less likely to commit another drug crime in the future.

In order for a person to be eligible for a “deferred entry of judgment” or a “judgment of dismissal”, he/she must complete a 12 week drug/alcohol treatment program, maintain good behavior for approximately 18 months, and pay a monetary fine to the court.  If the person completes all of these terms, his/her Orange County drug crime charges can be dismissed.
